The Control of Noise (Code of Practice for Construction and Open Sites) Order 1987

Made 25th September 1987
Laid before Parliament 7th October 1987
Coming into force 28th October 1987

    The Secretary of State for the Environment as respects England, the Secretary of State for Wales as respects Wales and the Secretary of State for Scotland as respects Scotland, in exercise of the power conferred by sections 71 and 104(1) of the Control of Pollution Act 1974[1] , and of all other powers enabling them in that behalf, hereby make the following Order:
    Citation and commencement
        1.    This Order may be cited as the Control of Noise (Code of Practice for Construction and Open Sites) Order 1987 and shall come into force on 28th October 1987.
    Approval of Code of Practice
        2.    The Code of Practice for noise control applicable to piling operations published by the British Standards Institution numbered BS 5228: Part 4: 1986[2] which came into effect on 31st January 1986 (and which is concerned amongst other things with the carrying out of works to which section 60 of the Control of Pollution Act 1974 applies) is approved as being suitable for giving guidance on appropriate methods of minimising noise.

EXPLANATORY NOTE

(This note is not part of the Order)
    Under section 71 of the Control of Pollution Act 1974 the Secretary of State may give guidance on appropriate methods for minimising noise by approving codes of practice. He is required to approve a code for the carrying out of works to which section 60 of the Act applies. These include building and roadworks, demolition, dredging and other works of engineering construction.
    This Order approves the code mentioned in article 2.
    The Codes of Practice contained in Parts 1 and 3 of the British Standards Institution publication "Noise Control on Construction and Open Sites" (BS 5228) were approved in relation to England and Wales by the Control of Noise (Codes of Practice for Construction and Open Sites) Order 1984 (S.I. 1984/1992) and in relation to Scotland by the Control of Noise (Codes of Practice for Construction and Open Sites) (Scotland) Order 1985 (S.I. 1985/145 (S.8)).
