MINISTERS OF THE CROWN The Transfer of Functions (Minister for the Civil Service and Treasury) Order 1987
At the Court at Buckingham Palace, the 26th day of November 1987 Present, The Queen's Most Excellent Majesty in Council
1.(1) This Order may be cited as the Transfer of Functions (Minister for the Civil Service and Treasury) Order 1987. (2) In this Order
(3) This Order shall come into force on 25th December 1987.
2.(1) There are hereby transferred to the Treasury the functions of the Minister with respect to
(2) Paragraph (1)(a) above shall not be construed as transferring to the Treasury the functions of the Minister under articles 1 to 3 of the Civil Service Order in Council 1982 (certificates of qualification) or his functions under article 4(a)(i) of that Order relating to the selection and manner of appointment of persons to the situations there mentioned and their qualifications in respect of matters other than age, education and professional attainment. (3) Paragraph (1)(e) above shall not be construed as relating to the making of senior appointments.
3. There are hereby transferred to the Minister the functions of the Treasury under section 2 of the Chequers Estate Act 1958[2] (Exchequer grants to administrative trustees).
4.(1) In Schedule 2 to the Parliamentary Commissioner Act 1967[3] as substituted by section 1(2) of the Parliamentary and Health Service Commissioners Act 1987[4] (departments and authorities subject to investigation)
(2) In section 22(4) of the Attachment of Earnings Act 1971[5] as amended by article 3(2) of the Transfer of Functions (Minister for the Civil Service and Treasury) Order 1981[6] (documentary evidence of Minister's determination of certain questions) for "Management and Personnel Office" there shall be substituted "Office of the said Minister" . (3) In section 2 of the Chequers Estate Act 1958 for "Treasury" , where it first occurs, there shall be substituted "Minister for the Civil Service" and where it subsequently occurs there shall be substituted "the Minister" . (4) Subject to any express repeal or amendment made by this Order, any enactment or instrument passed or made before the commencement of this Order shall have effect so far as necessary for the purpose or in consequence of the transfers effected by article 2 of this Order, as if any reference to the Minister or the Management and Personnel Office or an officer of the Minister (including any reference which is to be construed as such a reference) were a reference to the Treasury or an officer of the Treasury, as the case may be. (5) There are hereby transferred to the Treasury all rights and liabilities to which immediately before the commencement of this Order the Minister was entitled or subject in connection with any functions transferred by article 2 of this Order.
(2) Any approval, consent, direction or appointment given or made or other thing whatever done by the Minister or the Treasury for the purposes of any of the functions transferred by this Order from one of them to the other shall, if in force at the commencement of this Order, continue in force and have effect as if similarly given, made or done by the other.
