AGRICULTURE

The Environmentally Sensitive Areas (Breckland and Suffolk River Valleys) Designation (Amendment) Order 1988

Made 21st September 1988
Laid before Parliament 29th September 1988
Coming into force 20th October 1988

    Whereas, pursuant to section 18(1) of the Agriculture Act 1986[1] , the Minister of Agriculture, Fisheries and Food has by order designated areas in Breckland and the Suffolk River Valleys as environmentally sensitive areas[2] ;
    And whereas, pursuant to section 18(4) of the said Act, the said Minister has specified in the order designating the above-mentioned areas the requirements as to agricultural practices, methods and operations and the installation or use of equipment which must be included in agreements made under section 18(3) of the said Act as respects agricultural land in those areas;
    Now, therefore, the said Minister, in exercise of the powers conferred on him by section 18(1), (4) and (11) of the said Act, and of all other powers enabling him in that behalf, with the consent of the Treasury, hereby makes the following Order:—
    Citation and commencement
        1.    This Order may be cited as the Environmentally Sensitive Areas (Breckland and Suffolk River Valleys) Designation (Amendment) Order 1988 and shall come into force on 20th October 1988.
    Amendment of principal Orders
        2.—(1)  The Environmentally Sensitive Areas (Breckland) Designation Order[3] shall be amended in accordance with paragraph 2 below.

        (2)  In the first sentence of Schedule 2 (Requirements for arable land which is to revert to heathland or dry grassland), Schedule 4 (Requirements relating to uncropped wildlife strips) and Schedule 5 (Requirements relating to conservation headlands), the words "in rotation" shall be deleted.
        3.—(1)  The Environmentally Sensitive Areas (Suffolk River Valleys) Designation Order[4] shall be amended in accordance with paragraph 2 below.

        (2)  In the first sentence of Schedule 3 (Reversion to grassland) the words "in rotation" shall be deleted.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends Orders previously made by the Minister of Agriculture, Fisheries and Food which designated areas in Breckland and the Suffolk River Valleys as environmentally sensitive areas. The Order removes the requirement that land which is to revert to grassland or heathland in Breckland or the Suffolk River Valleys, or which is to be used for uncropped wildlife strips or conservation headlands in Breckland, should formerly have been cropped in rotation (articles 2 and 3).
