EDUCATION, ENGLAND AND WALES

The Education (Higher Education Corporations) (No.3) Order 1988

Laid before Parliament 28th October 1988
Coming into force 21st November 1988

    In exercise of the powers conferred by sections 122(1) and 126(2) of, and paragraph 4 of Schedule 7 to, the Education Reform Act 1988[1] the Secretary of State for Education and Science, having consulted in accordance with the said paragraph such associations of local authorities as appeared to him to be concerned, hereby makes the following Order:
        1.    This Order may be cited as the Education (Higher Education Corporations) (No.3) Order 1988 and shall come into force on 21st November 1988.
        2.    There shall be established, as from 21st November 1988, a body corporate to conduct, as from 1st April 1989, the institution known as the Falmouth School of Art and Design being an institution which appears to the Secretary of State to satisfy the criteria set out in section 122(1) of the Education Reform Act 1988 and whose full-time equivalent enrolment number for courses of higher education appears to him to exceed 350.
        3.    1st April 1989 is hereby appointed as the transfer date for the said corporation for the purposes of section 126 of that Act.
        4.    The County Council of Cornwall is hereby specified as the local authority entitled to nominate two local authority nominees as initial nominee members of the said corporation.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order makes provision for the establishment of a body corporate to conduct the Falmouth School of Art and Design. That body which, by virtue of paragraph 1(2) of Schedule 7 to the Education Reform Act 1988 will have the name of the Falmouth School of Art and Design, is established on 21st November 1988 to prepare itself for the conduct of that institution from 1st April 1989 which is appointed as the transfer date for the purposes of section 126 of that Act. It also specifies the County Council of Cornwall as the local authority able to nominate two local authority nominees to become members of that body corporate.
