SALMON AND FRESHWATER FISHERIES

The Upper Spey and Associated Waters Protection (Renewal) Order 1991

Made 5th February 1991
Coming into force 15th March 1991

    The Secretary of State, having received no complaints concerning the implementation of proposals, in exercise of the powers conferred on him by section 1(7) of the Freshwater and Salmon Fisheries (Scotland) Act 1976[1] and of all other powers enabling him in that behalf, hereby makes the following renewal Order:
    Citation and commencement
        1.    This Order may be cited as the Upper Spey and Associated Waters Protection (Renewal) Order 1991 and shall come into force on 15th March 1991.
    Interpretation
        2.    In this Order—
      "the 1982 Order" means the Upper Spey and Associated Waters Protection Order 1982[2]; and
      "the 1988 Order" means the Upper Spey and Associated Waters Protection (Renewal) Order 1988[3].

    Renewal of Order
        3.    The 1988 Order is hereby renewed.
    Prohibition
        4.    During the period from 15th March 1991 to 6th October 1991, both dates inclusive, fishing for or taking freshwater fish in the inland waters in the area prescribed in article 4 of the 1982 Order, without legal right or without written permission from a person having such a right, is hereby prohibited.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order has the effect of renewing for a third time the protection first granted by the Upper Spey and Associated Waters Protection Order 1982 which prohibited fishing for or taking freshwater fish in inland waters in the area prescribed in that Order without legal right or without written permission from someone having such a right. The effect of the renewal is that the prohibition applies during the period from 15th March 1991 to 6th October 1993.
    The prescribed area referred to is those parts of the catchment areas of the Rivers Spey, Spean and Tummel lying within Highland and Tayside Regions. The area is defined by reference to a large scale map which may be inspected at the Scottish Office Agriculture and Fisheries Department, Pentland House, Robb's Loan, Edinburgh on any working day between 8.30am and 4.30pm.
    The map annexed to and forming part of this note gives a general guide to the boundaries of the prescribed area.
