The Derbyshire, Leicestershire, Lincolnshire, Nottinghamshire and Warwickshire (County Boundaries) Order 1991

The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) and (5) of the Local Government Act 1972[1] and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect, with modifications, to the proposals submitted to him under sections 47, 48(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:
Citation and commencement 1.(1) This Order may be cited as the Derbyshire, Leicestershire, Lincolnshire, Nottinghamshire and Warwickshire (County Boundaries) Order 1991.
(2) This Order shall come into force on 19th March 1991 for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 1976[2].
(3) For all other purposes this Order shall come into force on 1st April 1991.
Interpretation 2. In this Order "boundary map" means one of the 8 maps prepared by the Department of the Environment, marked "Maps of the Derbyshire, Leicestershire, Lincolnshire, Nottinghamshire and Warwickshire (County Boundaries) Order 1991", duly numbered for reference and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976.
Transfers from Warwickshire to Leicestershire 3.(1) The part of the county of Warwickshire, the district of North Warwickshire and the parish of Mancetter marked A4 on boundary map 2 shall be transferred to
(a) the county of Leicestershire and the Market Bosworth electoral division of that county;
(b) the district of Hinckley and Bosworth and the Sheepy and Witherley ward of that district;
(c) the parish of Witherley and the Witherley ward of that parish;
(d) the Market Bosworth petty sessional division;
(e) the North Leicestershire Coroner's district.
(2) The part of the county of Warwickshire, the district of North Warwickshire and the parish of Mancetter marked A22 on boundary map 2 shall be transferred to
(a) the county of Leicestershire and the Market Bosworth electoral division of that county;
(b) the district of Hinckley and Bosworth and the Sheepy and Witherley ward of that district;
(c) the parish of Witherley and the Fenny Drayton ward of that parish;
(d) the Market Bosworth petty sessional division;
(e) the North Leicestershire Coroner's district.
(3) The part of the county of Warwickshire, the district of North Warwickshire and the parish of Hartshill marked A5 on boundary map 2 shall be transferred to
(a) the county of Leicestershire and the Market Bosworth electoral division of that county;
(b) the district of Hinckley and Bosworth and the Sheepey and Witherley ward of that district;
(c) the parish of Witherley and the Fenny Drayton ward of that parish;
(d) the Market Bosworth petty sessional division;
(e) the North Leicestershire Coroner's district.
(4) The part of the county of Warwickshire, the district of North Warwickshire and the parish of Caldecote marked A6 on boundary map 2 shall be transferred to
(a) the county of Leicestershire and the Market Bosworth electoral division of that county;
(b) the district of Hinckley and Bosworth and the Sheepy and Witherley ward of that district;
(c) the parish of Witherley and the Fenny Drayton ward of that parish;
(d) the Market Bosworth petty sessional division;
(e) the North Leicestershire Coroner's district.
(5) The part of the county of Warwickshire, the district of North Warwickshire and the parish of Caldecote marked A7 on boundary map 2 shall be transferred to
(a) the county of Leicestershire and the Market Bosworth electoral division of that county;
(b) the district of Hinckley and Bosworth and the Ambien ward of that district;
(c) the parish of Higham on the Hill;
(d) the Market Bosworth petty sessional division;
(e) the North Leicestershire Coroner's district.
Transfer from Derbyshire to Leicestershire 4. The part of the county of Derbyshire, the district of South Derbyshire and the parish of Netherseal marked A3 on boundary map 4 shall be transferred to
(a) the county of Leicestershire and the Ashby Woulds electoral division of that county;
(b) the district of North West Leicestershire and the Appleby ward of that district;
(c) the parish of Chilcote;
(d) the Ashby-de-la-Zouch petty sessional division;
(e) the North Leicestershire Coroner's district.
Transfers from Leicestershire to Derbyshire 5.(1) The part of the county of Leicestershire, the district of North West Leicestershire and the parish of Ashby Woulds marked B1 on boundary map 1 shall cease to form part of a parish and shall be transferred to
(a) the county of Derbyshire and the Swadlincote electoral division of that county;
(b) the district of South Derbyshire and the Gresley ward of that district;
(c) the Derby and South Derbyshire petty sessional division;
(d) the Derby and South Derbyshire Coroner's district.
(2) The parts of the county of Leicestershire, the district of North West Leicestershire and the parish of Ashby-de-la-Zouch marked A1 on boundary map 1 and A2 on boundary map 3 shall be transferred to
(a) the county of Derbyshire and the Melbourne electoral division of that county;
(b) the district of South Derbyshire and the Ticknall ward of that district;
(c) the parish of Smisby;
(d) the Derby and South Derbyshire petty sessional division;
(e) the Derby and South Derbyshire Coroner's district.
(3) The parts of the county of Leicestershire, the district of North West Leicestershire and the parish of Castle Donington marked A8 and A12 on boundary map 5 shall be transferred to
(a) the county of Derbyshire and the Melbourne electoral division of that county;
(b) the district of South Derbyshire and the Aston ward of that district;
(c) the parish of Weston upon Trent;
(d) the Derby and South Derbyshire petty sessional division;
(e) the Derby and South Derbyshire Coroner's district.
(4) The part of the county of Leicestershire, the district of North West Leicestershire and the parish of Castle Donington marked A9 on boundary map 5 shall be transferred to
(a) the county of Derbyshire and the Melbourne electoral division of that county;
(b) the district of South Derbyshire and the Aston ward of that district;
(c) the parish of Aston upon Trent;
(d) the Derby and South Derbyshire petty sessional division;
(e) the Derby and South Derbyshire Coroner's district.
(5) The part of the county of Leicestershire, the district of North West Leicestershire and the parish of Castle Donington marked A10 on boundary map 5 shall be transferred to
(a) the county of Derbyshire and the Melbourne electoral division of that county;
(b) the district of South Derbyshire and the Aston ward of that district;
(c) the parish of Shardlow and Great Wilne;
(d) the Derby and South Derbyshire petty sessional division;
(e) the Derby and South Derbyshire Coroner's district.
(6) The part of the county of Leicestershire, the district of North West Leicestershire and the parish of Lockington-Hemington, marked A11 on boundary map 5 shall be transferred to
(a) the county of Derbyshire and the Melbourne electoral division of that county;
(b) the district of South Derbyshire and the Aston ward of that district;
(c) the parish of Shardlow and Great Wilne;
(d) the Derby and South Derbyshire petty sessional division;
(e) the Derby and South Derbyshire Coroner's district.
Transfers from Leicestershire to Nottinghamshire 6.(1) The part of the county of Leicestershire, the district of North West Leicestershire and the parish of Lockington-Hemington marked A13 on boundary map 6 shall be transferred to
(a) the county of Nottinghamshire and the East Leake electoral division of that county;
(b) the district of Rushcliffe and the Soar Valley ward of that district;
(c) the parish of Ratcliffe on Soar;
(d) the Nottingham petty sessional division;
(e) the Nottinghamshire Coroner's district.
(2) The part of the county of Leicestershire, the district of North West Leicestershire and the parish of Kegworth marked A14 on boundary map 6 shall be transferred to
(a) the county of Nottinghamshire and the East Leake electoral division of that county;
(b) the district of Rushcliffe and the Soar Valley ward of that district;
(c) the parish of Ratcliffe on Soar;
(d) the Nottingham petty sessional division;
(e) the Nottinghamshire Coroner's district.
(3) The parts of the county of Leicestershire, the district of North West Leicestershire and the parish of Kegworth marked A15 on boundary map 6 and A16 on boundary map 7 shall be transferred to
(a) the county of Nottinghamshire and the East Leake electoral division of that county;
(b) the district of Rushcliffe and the Soar Valley ward of that district;
(c) the parish of Kingston on Soar;
(d) the Nottingham petty sessional division;
(e) the Nottinghamshire Coroner's district.
Transfer from Nottinghamshire to Leicestershire 7. The part of the county of Nottinghamshire, the district of Rushcliffe and the parish of Sutton Bonington marked A17 on boundary map 7 shall be transferred to
(a) the county of Leicestershire and the Castle Donington electoral division of that county;
(b) the district of North West Leicestershire and the Kegworth ward of that district;
(c) the parish of Kegworth;
(d) the Loughborough petty sessional division;
(e) the Northern Leicestershire Coroner's district.
Transfers from Lincolnshire to Leicestershire 8. The parts of the county of Lincolnshire, the district of South Kesteven and the parish of Stamford marked A18 and A19 on boundary map 8 shall be transferred to
(a) the county of Leicestershire and the Rutland North electoral division of that county;
(b) the district of Rutland and the Casterton ward of that district;
(c) the parish of Tinwell;
(d) the Rutland petty sessional division;
(e) the Northern Leicestershire Coroner's district.
Transfers from Leicestershire to Lincolnshire 9.(1) The part of the county of Leicestershire, the district of Rutland and the parish of Tinwell marked A20 on boundary map 8 shall be transferred to
(a) the county of Lincolnshire and the Stamford South electoral division of that county;
(b) the district of South Kesteven and the Stamford St. Johns ward of that district;
(c) the parish of Stamford and the St. John's ward of that parish;
(d) the Bourne and Stamford petty sessional division;
(e) the Stamford Coroner's district.
(2) The part of the county of Leicestershire, the district of Rutland and the parish of Little Casterton marked A21 on boundary map 8 shall be transferred to
(a) the county of Lincolnshire and the Stamford North electoral division of that county;
(b) the district of South Kesteven and the All Saints ward of that district;
(c) the parish of Stamford and the All Saints ward of that parish;
(d) the Bourne and Stamford petty sessional division;
(e) the Stamford Coroner's district.
Town and country planning 10. Any provision of a development plan applying to an area transferred by this Order shall continue to apply thereto notwithstanding the transfer; and after such transfer, any such provision shall, so far as it so applies, be for all purposes deemed to be a provision of a corresponding plan of the authority which becomes the appropriate local planning authority for the transferred area as a result of the transfer.

This Order transfers areas between the counties of Derbyshire, Leicestershire, Lincolnshire, Nottinghamshire and Warwickshire. Consequential changes to districts, parishes and local government electoral areas and to the areas of petty sessional divisions and Coroners' districts are made.
The map forming part of this note gives a general guide to the areas affected. Prints of the detailed boundary maps (described in article 2) may be inspected at all reasonable times at the offices of the district councils whose areas are affected by this Order, and at the office of the Secretary of State for the Environment, 2 Marsham Street, London SW1P 3EB.
