TERMS AND CONDITIONS OF EMPLOYMENT

The Employment Codes of Practice (Revocation) Order 1991

Made 28th May 1991
Coming into force 1st June 1991

    Whereas a draft of the following Order was laid before Parliament in accordance with section 12 of the Employment Act 1990[1] and approved by resolution of each House of Parliament:
    Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 12(7) of the Employment Act 1990, hereby makes the following Order:—
    Citation and commencement
        1.    This Order may be cited as the Employment Codes of Practice (Revocation) Order 1991 and comes into force on 1st June 1991.
    Revocation of Codes of Practice
        2.    The following Codes of Practice are revoked —
       (a) the Code of Practice having effect under paragraph 4 of Schedule 17 to the Employment Protection Act 1975[2] (known as the Industrial Relations Code of Practice);
       (b) the Code of Practice issued in 1983 under section 3 of the Employment Act 1980[3] entitled"Closed Shop Agreements and Arrangements" .

EXPLANATORY NOTE

(This note is not part of the Order.)
    This Order, which comes into force on 1st June 1991, revokes the Industrial Relations Code of Practice originally issued by the Secretary of State in 1972 under section 3 of the Industrial Relations Act 1971 (c.72). On the repeal of that Act by the Trade Unionand Labour Relations Act 1974 (c. 52), the Code was maintained in force by Part I of Schedule 1 to the 1974 Act; since the repeal of that Part by the Employment Protection Act 1975, the Code has been maintained in force by paragraph 4 of Schedule 17 to the 1975 Act.
    The Order also revokes the Code of Practice issued by the Secretary of State under section 3 of the Employment Act 1980 with the title"Closed Shop Agreements and Arrangements" . The Code was issued in 1983 and superseded an earlier Code of Practice issued under the same section and having the same title.
