HOUSING, ENGLAND AND WALES

The Housing Renovation etc. Grants (Prescribed Forms and Particulars) (Welsh Forms and Particulars) (Amendment) Regulations 1991

The Secretary of State for Wales, in exercise of the powers conferred on him by sections 102(2) and (4), 137(2), 138(1)^[1], 190(1) and 191(1) of the Local Government and Housing Act 1989^[2] as extended by subsections (2) and (3) of section 2 of the Welsh Language Act 1967^[3] and of all other powers enabling him in that behalf, hereby makes the following Regulations:

    1.—(1)  These Regulations may be cited as the Housing Renovation etc. Grants (Prescribed Forms and Particulars) (Welsh Forms and Particulars) (Amendment) Regulations 1991 and shall come into force on 15th July 1991.

    (2)  In these Regulations "the principal Regulations" means the Housing Renovation etc. Grants (Prescribed Forms and Particulars) (Welsh Forms and Particulars) Regulations 1991^[4].

Amendment of Regulations
    2.—(1)  The forms in the Schedule to the principal Regulations are amended in accordance with this regulation.

    (2)  Underneath the heading "Ffurflen 2" substitute for the heading "Cais am grant adnewyddu" the heading "Cais am grant cyfleusterau i'r anabl".

    (3)  At the end of question 3.13 in Form 1 "Application for renovation grant" (cwestiwn 3.13 yn Ffurflen 1 "Cais am grant adnewyddu") and at the end of question 3.13 in Form 2 "Application for disabled facilities grant" (cwestiwn 3.13 yn Ffurflen 2 "Cais am grant cyfleusterau i'r anabl"), insert the following-

    (5)  In note 28 in Form 1 "Application for renovation grant" (nodyn 28 yn Ffurflen 1 "Cais am grant adnewyddu") and note 28 in Form 2 "Application for disabled facilities grant" (nodyn 28 yn Ffurflen 2 "Cais am grant cyfleusterau i'r anabl") insert the words "chi neu'ch partner" after the words "os na fuoch" in the first reference thereto.

    (6)  After note 30 in Form 1 "Application for renovation grant" (nodyn 30 yn Ffurflen 1 "Cais am grant adnewyddu") and note 30 in Form 2 "Application for disabled facilities grant" (nodyn 30 yn Ffurflen 2 "Cais am grant cyfleusterau i'r anabl") insert the following as note 30A (nodyn 30A)-


    30A.    "Atebwch "ydwyf/ydyw" i'r cwestiwn hwn pe bai gennych chi neu'ch partner hawl i gael lwfans gofal analluedd oni bai am fudd-dâl cyffelyb yr ydych yn ei gael (hy budd-dâl anaf, atodiad am nad oes modd eich cyflogi, budd-dâl marwolaeth ddiwydiannol, neu fudd-dâl marwolaeth pensiwn rhyfel, a lwfans hyfforddi)."


    (7)  At the end of question 3.11 in Form 3 "Application for common parts grant" (cwestiwn 3.11 yn Ffurflen 3 "Cais am grant rhannau cyffredin") insert the following:

    (9)  In note 26 in Form 3 "Application for common parts grant" (nodyn 26 yn Ffurflen 3 "Cais am grant rhannau cyffredin") insert the words "chi neu'ch partner" after the words "os na fuoch" in the first sentence.

    (10)  After note 28 in Form 3 "Application for common parts grant" (nodyn 28 yn Ffurflen 3 "Cais am grant rhannau cyffredin") insert the following as note 28A (nodyn 28A)-


    28A.    "Atebwch "ydwyf/ydyw" i'r cwestiwn hwn pe bai gennych chi neu'ch partner hawl i gael lwfans gofal analluedd oni bai am fudd-dâl cyffelyb yr ydych yn ei gael (hy budd-dâl anaf, atodiad am nad oes modd eich cyflogi, budd-dâl marwolaeth ddiwydiannol, neu fudd-dâl marwolaeth pensiwn rhyfel, a lwfans hyfforddi)."


    (11)  In question 2.9 in Form 4 "Application for HMO grant" (cwestiwn 2.9 yn Ffurflen 4 "Cais am grant t mewn Amlddaliadaeth") where the sentence "(Ewch i 2.12)" appears susbstitute the sentence "(Ewch i 2.11)".

    (12)  In question 2.11 in Form 4 "Application for HMO grant" (cwestiwn 2.11 yn Ffurflen 4 "Cais am grant t mewn Amlddaliadaeth") where the sentence "(Ewch i 2.14)" appears susbstitute the sentence "(Ewch i 2.13)".

Transitional
    3.    In respect of any application for a grant made before 15th July 1991 in accordance with the provisions of the principal Regulations the provisions of those Regulations shall apply as if these Regulations had not come into force.

Mae'r Rheoliadau hyn yn diwygio'r Housing Renovation etc. Grants (Prescribed Forms and Particulars) (Welsh Forms and Particulars) Regulations 1991^[5] ("y prif Reoliadau"). Mae'r diwygiadau'n gyfieithiad i'r Gymraeg o'r diwygiadau a wnaed gan yr Housing Renovation etc. Grants (Prescribed Forms and Particulars) (Amendment) Regulations 1991^[6] i'r Housing Renovation etc. Grants (Prescribed Forms and Particulars) Regulations 1990^[7]. Mae Rheoliad 2(2) yn cywiro gwall ym mhennawd Ffurflen 2 y prif Reoliadau.

Mae Rheoliad 2(3) yn ychwanegu at gwestiwn 3.13 yn Ffurflen 1 (Cais am grant adnewyddu) a Ffurflen 2 (Cais am grant cyfleusterau i'r anabl) yn y prif Reoliadau ofyniad i ddatgan a ydys yn cael lwfans gofal analluedd. Mae Rheoliad 2(7) yn ychwanegu'r un gofyniad at gwestiwn 3.11 ar Ffurflen 3 (Cais am grant rhannau cyffredin). Mae Rheoliad 2(6) yn ychwanegu nodyn 30A ar Ffurflenni 1 a 2 sy'n rhoi arweiniad wrth ateb cwestiwn diwygiedig 3.13. Mae Rheoliad 2(10) yn ychwanegu nodyn 28A ar Ffurflen 3. Mae'r nodyn hwn yn rhoi arweiniad wrth ateb cwestiwn diwygiedig 3.11.

Mae Rheoliad 2(4) yn ychwanegu at gwestiwn 3.38 yn Ffurflenni 1 a 2 ofyniad i roi manylion unrhyw fenthyciad myfyriwr a manylion pellach am incwm elusennol a thaliadau gwirfoddol. Mae Rheoliad 2(8) yn ychwanegu'r un gofyniad at gwestiwn 3.36 yn Ffurflen 3.

Mae Rheoliad 2(5) yn ychwnegu geiriau tua dechrau nodyn 28 yn Ffurflenni 1 a 2. Mae Rheoliad 2(9) yn ychwanegu'r un geiriau tua dechrau nodyn 26 yn Ffurflen 3.

Mae Rheoliadau 2(11) a (12) yn peri mân ddiwygiadau i gywiro gwall mewn dau gwestiwn ar Furflen 4 (Cais am grant t mewn amlddaliadaeth).

Mae Rheoliad 3 (dros dro) yn darparu nad yw'r diwygiadau'n gymwys mewn perthynas ag unrhyw gais am grant a wnaed yn unol â darpariaethau'r prif Reoliadau cyn y dyddiad y daw'r Rheoliadau hyn i rym.

These Regulations amend the Housing Renovation etc. Grants (Prescribed Forms and Particulars) (Welsh Forms and Particulars) Regulations 1991^[8] ("the principal Regulations"). The amendments are a translation into Welsh of the amendments made by the Housing Renovation etc. Grants (Prescribed Forms and Particulars) (Amendment) Regulations 1991^[9] to the Housing Renovation etc. Grants (Prescribed Forms and Particulars) Regulations 1990^[10]. Regulation 2(2) corrects an error in the heading of Form 2 of the principal Regulations.

Regulation 2(3) adds to question 3.13 in Forms 1 (Application for renovation grant) and 2 (Application for disabled facilities grant) in the principal Regulations a requirement to state whether invalid care allowance is received. Regulation 2(7) adds to question 3.11 on Form 3 (Application for common parts grant) the same requirement. Regulation 2(6) inserts note 30A on Forms 1 and 2 which gives guidance in answering the amended question 3.13. Regulation 2(10) inserts note 28A on Form 3. This note gives guidance in answering the amended question 3.11.

Regulation 2(4) adds to question 3.38 in Forms 1 and 2 a requirement to give details of any student loan and further details about charitable income and voluntary payments. Regulation 2(8) adds to question 3.36 in Form 3 the same requirement.

Regulation 2(5) inserts words near the beginning of note 28 in Forms 1 and 2. Regulation 2(9) inserts the same words near the beginning of note 26 in Form 3.

Regulations 2(11) and (12) make minor amendments to correct an error in two questions on Form 4 (Application for HMO grant).

Regulation 3 (transitional) provides that the amendments do not apply in respect of any application for a grant made in accordance with the provisions of the principal Regulations before the date on which these Regulations come into force.
