ENVIRONMENTAL PROTECTION

The Control of Pollution (Amendment) Act 1989 (Commencement) Order 1991

Made 15th July 1991

    The Secretary of State, in exercise of his powers under section 11(2) of the Control of Pollution (Amendment) Act 1989[1], hereby makes the following Order:
    Citation and interpretation
        1.—(1)  This Order may be cited as the Control of Pollution (Amendment) Act 1989 (Commencement) Order 1991.

        (2)  In this Order "the Act" means the Control of Pollution (Amendment) Act 1989.
    Provisions coming into force on 16th July 1991
        2.    The following provisions of the Act shall come into force on 16th July 1991-
       (a) sections 1(3), 2, 4(6) and 8 to 11;
       (b) sections 3, 5(3) and (6) and 6 so far as they relate to the making of regulations.
    Provisions coming into force on 14th October 1991
        3.    Sections 3, 4 and 6 (so far as not already in force) and 7 of the Act shall come into force on 14th October 1991.
    Provisions coming into force on 1st April 1992
        4.    The remaining provisions of the Act shall come into force on 1st April 1992.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order brings the Control of Pollution (Amendment) Act 1989 into force in three stages-
        (1)  provisions needed to make subregulations are brought into force on 16th July 1991;

        (2)  provisions needed to start the process of registration of carriers of controlled waste and those dealing with the seizure and disposal of vehicles used for illegal waste disposal are brought into force on 14th October 1991;

        (3)  provisions creating the criminal offence of transporting controlled waste without registering and those imposing a duty to produce a person's authority for transporting controlled waste are brought into force on 1st April 1992.
