PILOTAGE

The Broads Authority (Pilotage Powers) Order 1991

Made 17th July 1991
Laid Before Parliament 24th July 1991
Coming into force 14th August 1991

    Whereas the Broads Authority is a harbour authority within the meaning of the Pilotage Act 1987[1] (hereinafter called "the Act of 1987" for the navigation area (hereinafter called "the harbour" described in section 8(1) of the Norfolk and Suffolk Broads Act 1988[2] but is not a competent harbour authority within the meaning of the Act of 1987:
    And whereas the Broads Authority wishes to be treated as a competent harbour authority for the purposes of the Act of 1987:
    And whereas the Secretary of State has informed the persons he considered might be affected by the Order, in accordance with section 1(7) of the Act of 1987:
    And whereas the making of this Order is not opposed:
    Now therefore the Secretary of State for Transport, on the application of the Broads Authority, in exercise of the powers conferred on him by section 1(4) of the Act of 1987, and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation
        1.    This Order may be cited as the Broads Authority (Pilotage Powers) Order 1991.
    Application of Pilotage Act 1987
        2.    The Broads Authority shall be a competent harbour authority in respect of the harbour for the purposes of the Act of 1987.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order provides that the Broads Authority is to be a competent harbour authority for the purposes of the Pilotage Act 1987 and the Order defines the area of its harbour for these purposes by reference to the Norfolk and Suffolk Broads Act 1988.
    The application for the Order is the Broads Authority, Thomas Harvey House, 18 Colegate, Norwich, Norfolk NR3 1BQ.
