The Testing in Primary Schools (Scotland) Amendment Regulations 1991

    The Secretary of State, in exercise of the powers conferred on him by section 2 of the Education (Scotland) Act 1980[1], and of all other powers enabling him in that behalf, hereby makes the following Regulations:
    Citation, commencement and interpretation
        1.—(1)  These Regulations may be cited as the Testing in Primary Schools (Scotland) Amendment Regulations 1991 and shall come into force on 19th August 1991.

        (2)  In these Regulations, "the principal Regulations" means the Testing in Primary Schools (Scotland) Regulations 1990[2].
    Amendment of the principal Regulations
        2.    In regulation 3(5)(a)(i) of the principal Regulations (attainment tests), for the words "15th November" there shall be substituted "31st March".
        3.    In regulation 3(6) of the principal Regulations (attainment tests), the words "within the period from 1st March to 30th April" shall be deleted.
        4.    In regulation 5(2) of the principal Regulations (provision of information on the result of tests), for sub-paragraph (b) there shall be substituted the following sub-paragraph:-
        "(b) a summary of the results of those tests is provided to the school board of that school, where it is possible to do so without identifying the results of any individual pupil." .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Testing in Primary Schools (Scotland) Regulations 1990 in three respects. Firstly, they alter the latest date by which an education authority are required to order attainment test materials in respect of a school year from 15th November to 31st March, the amendment having effect from 19th August 1991. Secondly, they remove the requirement that attainment tests which are to be held in each school year are to be held within the period 1st March to 30th April. In respect of the school year commencing on 1st August 1991, tests may be held at any time during that school year from 19th August 1991, being the date these Regulations come into force. In respect of future school years, tests may be held at any time during the school year. Thirdly, they restrict the requirement to ensure that a summary of test results in a school is provided to the school board of that school so that it applies only where it is possible to give such summary without identifying an individual pupil's results.
