PILOTAGE

The Pilotage Act 1987 (Cessation of Temporary Arbitration Procedure) Order and Regulations 1991

Made 30th August 1991
Laid before Parliament 10th September 1991
Coming into force 1st October 1991

    The Secretary of State for Transport, in exercise of the powers conferred on him by sections 5(7) and (8) and 32(1), of the Pilotage Act 1987[1], and of all other powers enabling him in that behalf, hereby makes the following Instrument:
        1.    This instrument may be cited as the Pilotage Act 1987 (Cessation of Temporary Arbitration Procedure) Order and Regulations 1991 and shall come into force on1st October 1991.
        2.    The Secretary of State hereby orders that the day prescribed for the provisions of section 5(1) to (7) of the Pilotage Act 1987 (temporary arbitration procedure) ceasing to have effect is 1st October 1991.
        3.    The Secretary of State hereby makes the following regulations:
       (i) The Terms of Employment of Pilots (Arbitration) Regulations 1988[2] are hereby revoked; and
       (ii) The cessation of effect of section 5(1) to (7) of the Pilotage Act 1987 on1st October 1991 shall not affect any arbitration commenced before that date, and the provisions of the Terms of Employment of Pilots (Arbitration) Regulations 1988 shall continue to apply to such arbitrations, notwithstanding their repeal.

EXPLANATORY NOTE

(This note is not part of the Orderand Regulations)
    This Order and Regulations appoint 1st October 1991 as the day on which the temporary arbitration procedure for resolving disputes as to pilots' terms of employment ceases to have effect, but preserve the existing procedure for arbitrations commencing before that date.
