MAGISTRATES' COURTS

The Juvenile Courts (Constitution) (Amendment) Rules 1991

Made 19th September 1991
Laid before Parliament 23rd September 1991
Coming into force 14th October 1991

    The Lord Chancellor, in exercise of the powers conferred upon him by section 144 of the Magistrates' Courts Act 1980[1], after consultation with the Rule Committee appointed under the said section 144, hereby makes the following Rules:
        1.—(1)  These Rules may be cited as the Juvenile Courts (Constitution) (Amendment) Rules 1991 and shall come into force on 14th October 1991.

        (2)  In these Rules "the principal Rules" means the Juvenile Courts (Constitution) Rules 1954[2].
        2.    In rule 1 of the principal Rules—
       (a) in paragraph (2), the words "the number of" and the words "who have not attained the age of sixty-five years" shall be omitted; and
       (b) in paragraph (4), the words "and who has not attained the age of sixty-five years" shall be omitted.
        3.    In rule 2 of the principal Rules, the words "whether or not he has attained the age of sixty-five years" shall be omitted.
        4.    Rule 5 of the principal Rules shall be omitted.
        5.    In rule 7 of the principal Rules, the words ", subject to Rule 5 of these Rules," shall be omitted.

EXPLANATORY NOTE

(This note is not part of the Rules)
    These Rules amend the Juvenile Courts (Constitution) Rules 1954 by removing the requirement that a justice be under the age of sixty-five years for membership of a juvenile court panel.
