(2) Where, in relation to any pending application made after 12th April 1995 and before 17th April 1995, the relevant person is not entitled to a disability premium or higher pensioner premium within the meaning of Part III of Schedule 1 to the Housing Renovation etc. Grants (Reduction of Grant) Regulations 1994[4] but would have been so entitled had the application been made on 17th April 1995, for the purposes of that relevant person's entitlement to a disability premium or higher pensioner premium his application shall be treated as if it had been made on 17th April 1995.
