COAL INDUSTRY

The Miners' Welfare Act 1952 (Transfer of Functions of Coal Industry Social Welfare Organisation) Order 1995

Made 22nd March 1995
Coming into force 23rd March 1995

    Whereas a draft of this Order has been approved by resolution of each House of Parliament under section 15 of the Miners' Welfare Act 1952:
    Now, therefore, the Secretary of State, in exercise of the powers conferred on him by sections 12(3) and 15 of the Miners' Welfare Act 1952[1], and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation, commencement and interpretation
        1.—(1)  This Order shall be known as The Miners' Welfare Act 1952 (Transfer of Functions of Coal Industry Social Welfare Organisation) Order 1995 and shall come into force on the day after the day on which it is made.

        (2)  In this Order—
      "the 1952 Act" means the Miners' Welfare Act 1952; and

      "the Social Welfare Organisation" has the same meaning as in the 1952 Act[2].

    Transfer of Functions of Coal Industry Social Welfare Organisation
        2.    The persons to whom the functions of the Social Welfare Organisation shall be transferred in accordance with section 12(3) of the 1952 Act shall be the trustees, in their capacity as such trustees, of the trust which is known as "The Coal Industry Social Welfare Organisation" and is registered with the Charity Commissioners under the Charities Act 1993[3] with the number 1015581.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order prescribes the persons to whom the functions of the Coal Industry Social Welfare Organisation ("CISWO"), a limited company incorporated under the Companies Act 1948, are to be transferred in accordance with section 12(3) of the Miners' Welfare Act 1952. By section 22(3) of the Coal Industry Act 1994, the functions transferred are all of CISWO's functions, whether or not these arise under the 1952 Act.
