EDUCATION, ENGLAND AND WALES

The Education (Mandatory Awards) (Amendment) Regulations 1995

The Secretary of State for Education, in exercise of the powers conferred by sections 1 and 4(2) of the Education Act 1962^[1], hereby makes the following Regulations:

    1.    These Regulations may be cited as the Education (Mandatory Awards) (Amendment) Regulations 1995 and shall come into force on 1st June 1995.

    2.    The Education (Mandatory Awards) (No. 2) Regulations 1993^[2] are amended in paragraph 1(1) of Schedule 3 by adding the following sub-paragraph to the end: "(v) any payment made to the student as a "Career Development Loan" in pursuance of section 2 of the Employment and Training Act 1973^[3]".

    3.    The Education (Mandatory Awards) Regulations 1994^[4] are amended—
 (a) in paragraph 16(c) of Schedule 2 by substituting for the words "previous course in respect of which he held an award (or was in receipt of a grant under arrangements made under section 2 of the Education Act 1962)" the words "full-time course of further or higher education which he had started before 1st September 1995"; and
 (b) in paragraph 1(1) of Schedule 3 by adding the following sub-paragraph to the end: "(v) any payment made to the student as a "Career Development Loan" in pursuance of section 2 of the Employment and Training Act 1973".

These Regulations, which come into force on 1st June 1995, amend the Education (Mandatory Awards) (No. 2) Regulations 1993 and the Education (Mandatory Awards) Regulations 1994, the latter of which do not come into force until 1st September 1995.

They provide that a Career Development Loan shall be disregarded in calculating a student's income for the purposes of determining his entitlement to a maintenance grant.

They also make provision for the payment of an older students allowance to a student attending a course starting after 1st September 1995 if he has immediately before starting that course attended a full-time course of further or higher education which he started before 1st September 1995, if he has earned £12,000 in the three years before the first year of the first course, and if has attained the age of 26 before the first year of the second course.
