EDUCATION, SCOTLAND

The Education (Fees and Awards) (Scotland) Amendment Regulations 1995

Laid before Parliament 11th May 1995
Coming 1st June 1995

    The Secretary of State, in exercise of the powers conferred on him by sections 1 and 2 of the Education (Fees and Awards) Act 1983[1], hereby makes the following Regulations:
    Citation and commencement
        1.    These Regulations may be cited as the Education (Fees and Awards) (Scotland) Amendment Regulations 1995 and shall come into force on 1st June 1995.
    Amendment to the Education (Fees and Awards) (Scotland) Regulations 1983
        2.    Regulation 4 of the Education (Fees and Awards) (Scotland) Regulations 1983[2] shall be amended—
       (a) in paragraph (1) by deleting the words "full-time or sandwich"; and
       (b) in paragraph (2) by deleting the definitions of the terms "full-time course" and "sandwich course".
    Saving for students commencing course before 1st September 1995
        3.    The amendments made by regulation 2 shall not apply as respects the charging of relevant fees to a student in respect of a course which he begins to attend before 1st September 1995.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Education (Fees and Awards) (Scotland) Regulations 1983 to extend the existing power to charge higher relevant fees in the case of students who do not have a relevant connection with the United Kingdom and Islands, and are not excepted students within the meaning of Schedule 1 to those Regulations. The power, which applied to students undertaking full time and sandwich courses, is extended to cover also students who undertake part-time courses.
    The power to charge such higher relevant fees will not apply where the student begins the part-time course before 1st September 1995.
